Gray-Nicolls preventing non-EU exporting?!

I've just read in the new Gray-Nicolls Terms & Conditions, the following, highly controversial point:

"EXPORT - Goods are sold to the Customer on the express condition that the Customer will not (directly or indirectly) export them to any country outside the European Economic Union."

Before I contact Gray-Nicolls to query this and vent some frustration, I'd appreciate some feedback as to the whys and wherefores of what, to me, is a ridiculous rule!

It is odd, but whether its ridiculous I really don't know - I mean, they're hardly the first manufacturer to limit the export of their goods are they?

I can see two possible reasons - the first being a desire to avoid a clash with GN Australia, who market different (and to my mind better) bats.  The other is that they may wish to clamp down on fakes and see a possible way of doing so as ending the movement of their bats to certain markets?

Surely limiting the movement of their bats to certain markets is only going to increase the number of fakes? As people in those markets desire GN bats but are unable to get them through legal methods..

But limiting it to just EU, prevents perfectly viable markets, like the US and Canada, who buy in big numbers and don't necessarily compete with GN Australia.  Of course, I don't mind not exporting to places like Pakistan, though!  ;)

They already have distributors in place in USA and Canada, who I suppose GN are trying to push sales through.

With them adding the E41 and A61 to the ranges the UK will probably be cheaper, and that may be their main worry.

yes, but it will also make clear which are fakes and thereby limit the damage that fakes can do to GNs reputation

Surely it's just a distribution agreement they have with their respective distributors?

If it's any consolation I'd assume the Yank/India/Pakistan/Aus retailers have similar agreements so UK buyers will HAVE to come to you!

Just a shame that most people who've wanted to buy GN bats from us have been based in the USA / Canada! It's a no-win situation for us...

I think I will, Tom.  I don't recall seeing it on last year's Ts and Cs either...
