I'm fairly certain that he owns the PR company that represents him..........that's why he's so badly advised all the time....!

Or else he's just spending too much time listening to the oxygen thief that is Piers Morgan.......I would cross the road to throw hands at that man...!

this is just a rehash of an old article, the ECB know they are in trouble and have asked for a assurances that they won't be sued in the negotiations.

surely its gross misconduct what he has done. is there any difference  him sending texts saying strauss cant bat outside his off stump, get him out this way to me giving away trade secrets of the company i work for. so he starts the whole thing by being a dick and he then expects to get paid for it? employment law and contracts are flawed!

The problem is if he gets a contract by default then he'll never play for England again under Flower/Cook/Broad etc and in a years time he'll be left out for "cricketing reasons". If he sues the ECB then he'll never play for England again either, as much as a message to others that there are consequences to taking the ECB to court. Both will effectively spell the end of his lucrative sponsorship deals based primarily on him playing for England. Can't see Adidas paying him a fortune to been seen on TV occasionally on ITV4 in May.

It's just a threat to kick things on.

I think the ECB have slipped up by not following Employment Laws and issuing a breach of contract notice, though they might argue they have issued an informal warning in light of the meetings they have held regarding his conduct. However, they should of terminated his contract if they wished to not award him another for this reason.

If his contract is anything like the standard contracts we give to non-permanent staff, on expiry of the contracted period, the "employee" is out of contract and there is no auto renewal. If this is the case with KP (i.e., his 12 month contract has expired) then what can he sue the ECB for? If they have paid him up to the end of the contracted period, then, frankly, tough! He is technically employed by Surrey, after all...

After service longer than 12 months, contracted staff are considered full-time employees in the eyes of the law. Pietersen has been centrally contracted by the ECB for six years and the failure to renew a fixed-term contract is technically dismissal by his employer.

no the text merely discussed approaches they could take to enhance their performance - according to his lawyer  :)

Easy answer, just ask the saffa's and the telco carrying the texts for the information.

Technically, he is employed by Surrey though, who pay KP through funds provided by the ECB....
