What to do......
« on: December 09, 2009, 11:20:33 AM »

HI guys,

I bought this LW for a forum member yesterday and the least I can say is that the bat is a total wreck. However, the seller maintains that there is no problem with the bat and that I should have expected to receive the bat in this condition.

My question is: Should the seller not made clear in his listing that the bat had crack and broken edges?

I asked the seller to refund me the money less the postage and he refused saying he has already spent the money!!

He was fully aware of the condition of the bat and willfully ignored to mention it in his emails or listing on the forum....

He sent me the pictures of the bat but with the antiscuff and edging tape on, so it was impossible for me to make out if there was any damage to the bat.

Should I not be entitled to a refund?

Also the seller claimed to have spent £12 on the postage whereas the printed postage on the box mentioned £6.66!! According to the seller Special Delivery costs £17.00!! I just sent a bat out today morning to petehosk using special delivery and it coat me £8.65!! But the seller of this rubbish bat to me claims that Royal Mail in his area charge £17.00!!! How on earth is this possible??

Some pictures of the bat:

I put a piece of paper in the crack along the edge and it came out from the crack along the 2nd grain!!

The cracks run under the face of the bat which make the willow puffy.....i hope the batmakers on the forum get what i am saying.

You could sue him for false marketing and listing.

If you report this to eBay you will get a full refund . . .open a case against the seller. If the item description failed to mention any crack etc you will get your money back

How much did it cost you?

I wish it was a eBay transaction, I would have ripped the guts of this guy!!!.

Unfortunately, I bought this from a forum member and paid £100 for it as the listing mentioned it was LW Private Bin

Royal mail postage is standard rate SD @ £8.65 and 1st class at £6.60 ish. It wont vary if your if an affluent area!!

Next day delivery with our courier which you can track is only £7.50 so not sure where he has plucked the figure £17.00 from as the bat would be under 2kg when sending it.

Sounds like a difficult issue to tackle if he wont offer a refund and a wallpapering over the cracks has occurred with the edge tape and face sheet! I would hope honesty and integrity would prevail and he should realise the fact you haven't named and shamed him in your post and are looking for some opinions to resolve the matter maybe he would reconsider his stance.

If you paid by paypal then can't you take it up with them as I thought they were pretty hot on this type of thing?

Hi mate - I would speak to Leo and the other forum administrators to see what they suggest?

And also try to resolve the issue in a diplomatic way?

I have a Private Bin, and they are normally excellent bats - assuming of course that they have been knocked in properly and are not on their last legs with cracks all over the place!   :-\

If you could wait for a week or two, then maybe whoever sold you the bat could be persuaded to save the money up to repay you for this bat - that was obviously not as described! If the seller is willing to come to a fair agreement to pay the money back over a couple of weeks, then do you think you could be happy with that?

But if the seller is not willing to be fair, then PLEASE tell us all who they are, as there are a few people who like to buy the odd bat or two! And we should really know who we should avoid!!  >:(

Sorry that is a typo error. I bought the bat from a forum member.

Made a direct bank transfer.

I wanted to try a LW bat before buying one and hence thought of buying this one assuming I woudl get a good bat at a good price. But it was not to be.

I am very sure the bat was not knocked in well as the middle is a bit concaved...hope you get what I am saying.

I'm afraid this is one of the downfalls of the forum - no safety for people buying any goods - tough luck on this one Yash, seems like you got sold a duffer and from what you say it sounds as if the bat is de-laminating on the face........which isnt good.

I got stung by a member on the forum before so make sure i have good comms with the buyers/sellers in case things happen, but this doesnt stop people doing what they've done to you - shame on them.

By the way, most Laver faces have a slight concaving due to the press James has, havnt seen it on many other bats before to be honest.

exactly my point mate. Everyone makes mistakes. But if they are prepared to acknowledge them and correct them then there is no problem. But if they want to argue and try to defend their mistake (whether intentional or unintentional) then it is wrong.

This is exactly the reason why I have not mentioned the seller's name.....

I have had many bats and I can tell there is not much left in this bat. When you tap the ball you can hear 2 sounds as the top of the willow is detached from the lower in some places. But the seller insist it is because it is a carbocane handle.....I have owned a C6+ and I know they make a different sound but not like the one i get on thsi bat....

Slightly confused you put a piece of paper in the edge [side of the bat] and it went through it and came out at the second grain on the face?

I sent the seller the pictures of the bats last night and got the followign text back this morning:

Text 1:
"When I attached the last anti scuff on to the bat all those marks were on the blade and the performance was still top notch. With a good refurb those superficial marks will be gone and the bat will be ace, remember the bat is 2 years old now...."

I responded saying that by no length of imagination these were superficial cracks and that I could slide a sheet of paper right through some of the crack.

Text 2 from the seller:
" I didn't think I needed to mention the slight cracks due to the age of the bat and the nature of the wood and how it ages. When I put a new scuff sheet on it the cracks were that big i'd go for of refurb it then but they weren't"

Like Dom said, the top of the bat has de-laminated from the rest of the wood.....

I spoke to one of the bat makers today and they asked me to put a bit of superglue and see if the bat made a different sound.  I put some super glue on the crack on the edge and it came straight out from the face of the bat!!! Thats how bad the cracks are.

Did it as best i could be the bat is definitely on a death bed.
